To begin with, my para-legal was Mrs. Ashley Scherer. She was particularly helpful regarding a number of pre-filing, post-filing and post-discharge issues which I have faced as well as patient through my process of gathering various documents which were needed. I also appreciate her flexibility and patience regarding my need to reschedule appointments due to unforeseen conflicts in my own schedule.
I am very appreciative to the office in general, and the attorney who represented me, Benjamin Busch. I also wish to mention my post-legal Patty Cherigo. As a graduate student with four children, it has not been easy to keep up with finances and afford life. Falling into debt was certainly not a strategy I was counting on nor intended. My successful bankruptcy has enabled me to clear a significant burden and source of stress from my life as well as given me a chance to start again properly from a clean slate.
My rental was cancelled and I had no charge. My purchase cost me $1000 more in down payment and will cost me $60/month more for the next SIX years - at 18%. I believe because I couldn't take my time and find the right plan for me.
While I do appreciate your apology and taking ownership of the initial late filing, nothing about ending this lease and purchasing a new vehicle went as planned, and when I saw there was going to be some issues, my begging the LOJO fell on deaf ears. I've lost a half-days pay and I'm in debt for another 6 years, with a payment I'm praying I can afford. I don't know how that can be made right. But I'm learning that is what happens to people who struggle financially. They simply have no recourse.
UPDATE - September 16 - Apparently the satisfactory solution is to tell me "they will make it good" then ignore me. I turn my leased vehicle tomorrow. Even though the court approved my petition for an auto loan, the letter that allows me this luxury is still in the court system.
My car lease is up tomorrow and now I'm renting a car - at MY expense. I have a $395 end of lease fee that I was hoping to roll into the used car purchase . . . now I pay that out of pocket. All of this will come from my meager down payment.
I think the frustrating thing is that the Law Office of John Orcutt simply dropped the ball on this for four weeks, ignored my pleas when I suggested my court date will not allow me to buy a car in time, and now are just wanting me to go away as I can get no guidance or response from anyone. And I paid them $250 (added to my bankruptcy total) for the debacle and will be out nearly $500 in cash.
But I'm in a bankruptcy. You really have no advocate.
UPDATE: I received a call from Mr. Orcutt, he and his firm have taken ownership of my situation and have found a satisfactory solution to my issue. I thank Mr. Orcutt for the time he took to personally help me. Raising the review from 2 to 4 stars!
I filed a Chapter 13 in January 2017. The Law Offices of John T. Orcutt (LOJO) did a good job and I've been satisfied with my case . . . until now. My auto lease was put OUTSIDE the C-13 and I paid it off early (paid off in July, to turn the car in on Sept 17). I need permission from the court to get an auto loan for a used vehicle and LOJO began the process for me on June 22. After numerous emails asking for a status, I received an email in mid-August stating that it had fallen through the cracks but is now being handled - my court date set for Friday afternoon, September 13 - four days before I turn my car in. I expressed my concerns in August and was told it will be fine . Now my attorney handling the case tells me I may receive the letter as early as Monday or as late as Wednesday (or later), as it's up to the clerk. I have no vacation days left, so I now have to take days off without pay, and possibly go without transportation (renting a car?), just so I can work. The individuals I've spoken to and emailed with at LOJO seem sympathetic - not enough to do anything about this. It's been one pat on the hand after another, but it's me that wiil have to deal with the fiasco. If you must get court approval using LOJO, make sure you do it more than 90 days in advance, otherwise, they can't handle it. - Mark Moore

I was nervous and unsure before making the decision to file bankruptcy but Jessica gave me the confidence and reassurance to move forward.
