It was clear that he had the knowledge of the law, work ethic, and strategic approach to tackle this at the right angle to plead my case and get the best result possible.
After being given the option of a differed sentence and a DWAI (which many lawyers would say to take that), he advised that we should not, and that he was confident he could get a better result.
After just two visits to the court he was able to get all of my charges completely dropped and thrown out! He answered all my questions no matter how large or small, and made me feel confident the whole way through as well as following the case. Every aspect of this case was handled in a professional matter and I could not have asked for a better representative to be on my side. 5 STARS!
I have three major complaints with how he handled my case. 1) He didn’t make any effort to meet with me to prepare for the case or to thoroughly discuss the plea deal; 2) He didn’t seek out all available evidence, and 3) I believe he provided me with false legal information. I discuss each below.
1) Mr. Sunness was not responsive to questions and requests to meet. He did not respond to either of two emails I sent him requesting a sit-down meeting. After no response, I had to call and schedule a meeting the day before the disposition. The meeting ended up being brief and not exhaustive. On the day of my disposition Mr. Sunness had two other cases in the same time slot. He requested I get there a half hour early – I did. While discussing the plea bargain he was clearly agitated saying “you ask so many questions” and stated that he had two more plea bargains to present to clients prior to the hearing. He had scheduled all three plea bargain discussions for the half hour prior to court!
2) During his initial meeting with me he stated that he would obtain a copy of the noise complaint that made the police come to my door. When the complaint wasn't included in the evidence provided he did not follow up to obtain it. The party at my house was a grad-student party which everyone road bikes to. It was not unruly. When standing outside the front door with the cops it could not be heard. Because of his failure to obtain record of any complaint, to this day I am not sure that the police received one - or if the 'Neighborhood Enforcement Team' officers who showed up
only saw flashing lights in the windows and came to shut it down (illegal).
3) I believe Mr. Eric Sunness provided me with false information in the meeting immediately preceding me signing a plea bargain. The night of the incident I had a calm conversation with the police which ended with them stating they saw no reason to charge me for excessive noise and they appeared ready to leave – when they asked me for my driver’s license. I was wearing a costume and did not have it on me. They asked me to go search my house and I declined (they said I wasn’t being charged and they appeared to be leaving, so why go get it?). I was arrested for not producing a driver’s license. When I stated to Eric that I didn’t feel the police were justified in arresting me for this he told me sternly that I was obligated to provide ID to them by CO law. I was taken aback by his tone and seriousness and being from out of state did not question that statement.
The law however is different. Since it was not a traffic stop I was not obligated to do anything more than verbally state my name and address, which I had already done (on video). Because the sole reason I was arrested was for not retrieving an ID, I believe that Mr. Sunness missed a reason to get the whole case dismissed and possibly to bring a case against the police officers.
To conclude, I do not feel that Mr. Sunness even considered if there was a legal basis for my arrest and subsequent 13 hour detention. Instead he sought a fast plea bargain on the case, because he had too many cases. He then misguided me into accepting that plea.
I picked Mr. Sunness because of the good reviews online (best in town!), that’s why I felt I had to share my story. The Fort Collins Police force is horrible to deal with for any reason. If you or a loved one must answer to their trumped-up charges (or any charges for that matter) in court look elsewhere for thorough legal representation.
He did what he said, no b.s.
Better then expected results.
