SITUATION: I was selling my house and once it went under contract, Knipp Law Firm started preparing the closing documents. I made arrangements with them and confirmed that I would sign my documents the week before the closing for no additional charge since I could not attend the closing date. Coley Law Firm was then brought in halfway through the process when the buyer's lender, Region's Bank, halted the closing because Knipp Law Firm was not considered their 'preferred attorney' but Coley Law Firm was, so it was mandatory the buyer use Coley Law Firm. However, Coley Law Firm charges a $150 transfer fee to sellers if they sign their documents at a different time other than at the closing. I already established and confirmed a time 1 week before the closing with Knipp Law to sign my documents without additional fees. I emailed Coley Law Firm to let them know it would be the buyer's responsibility to pay this fee since this fee was added when Coley became the buyer's attorney. Coley Law Firm's reply was that this fee is not negotiable and they charged it to me in the closing documents. This issue was resolved by Knipp Law Firm (the first attorney) reducing their fee by $150 to offset Coley's transaction fee charge. FYI- I did not propose this solution and it was worked out between the realtors and Knipp Law Firm.
Coley Law Firm sent 1 document for me to wet sign 2 days before the closing. Then the afternoon on the day for the closing, they sent 2 more documents for me to wet sign. My realtor asked why weren't the documents all prepared at the same time and sent for me together to sign 2 days before the closing. The response from Coley Law Firm was 'they didn't know'. This demonstrates how Coley Law Firm is inefficient and forgetful during real estate closings.
The day of the closing: After the closing documents were signed by the buyer and recorded, I received a call from Mary at Coley Law Firm at 4:09pm to verify my bank account so they could wire the money. I called them back and the girl, who answered the phone, attempted to transfer my call to Mary in their office but hung up on me. Why is Coley Law Firm employing people who don't know how to use their own phone system? I told them I already completed a form with my bank account details and provided a voided check to Knipp Law Firm so whatever account # they had to use that. I then stated that I was done with their incompetent behavior throughout this closing process. Mary's response was "I have to talk to the attorney." My realtor emailed them to see what the problem was and to make sure I would receive the money from the sale of my house. They said their office policy is to verbally confirm account numbers on all wire transfers and since I didn't confirm it, they would mail me a check instead. My realtor then asked them to refund the $85 wire fee they charged me since no wire transfer was done. They refused and said the money would be used toward the overnight shipping of the check. The cost of the Fed Ex priority overnight letter charge is $30.10. The wire transfer fee is $85, so the $54.90 difference they kept and refused to return to me. That is not their money, it is mine! Why couldn't Coley Law Firm verify my bank account details days before the closing so on the closing date everything was already verified and the funds could be transferred the same day without issue?
What kind of kickback does Coley Law Firm give Regions Bank for their business for real estate closings so that Regions Bank halts closings with attorneys who aren't on their preferred list?
After everything that happened throughout this closing, who should be the 'preferred attorney' now? The one that acts professional and has all documents ready a week before the closing and reduces their fees in order to get the property closed, or the one that is incompetent, inflexible, and keeps sellers' money that doesn't belong to them?
